Mental Incompetence And Finances

Would like to know how to invoke POA for someone who has become mentally incompetent. Hubby is suffering from Capgras. Thinks there are more than one of me. The bad one is trying to steal his money. He wants to see a lawyer. Anyone else facing this issue? How did u handle it. He’s extremely delusional so telling him I need to legally take over our finances isn’t an option.

You need to talk to his doctor about what's going on there are meds that help

Thanks Les. He had Covid and just never fully recovered from the complete psychosis it put him into. We have started Seroquell and Nuplazid. Trying to get the delusions especially under control. He has a neurologist and a movement disorder specialist. Praying meds will help.

Does he have a POA that names you? If so, talk to the attorney who drew it up about what, if anything, is required to put it in effect. You might need a letter from your husband's doctor explaining that he is delusional. If he didn't set up a POA when he was competent, you may need to have him declared incompetent. Again, talk to your lawyer.

Dkhewitt. I did get a letter from neurologist and have gotten invested funds protected.

I find it extraordinarily difficult to take away my husband’s independence, even with a POA in place. He has been moving documents around from files I have kept. I have told him I must put a lock on a door to protect my documents. He refuses to allow it.
